Privacy Policy

Privacy Policy

This Privacy Policy explains how SOGO Collective USA, Inc., doing business as STXND, together with its affiliate Sogo Collective Inc. ("STXND," "we," "us," or "our"), collects, uses, shares, and protects personal information when you visit stxnd.com (the "Site"), make a purchase, sign up for our emails or text messages, contact us, or otherwise interact with us (together, the "Services"). By using the Services, you acknowledge the practices described in this Policy.

If you buy STXND products on a third-party marketplace such as Amazon, that marketplace's privacy policy governs the information you provide to it.

1. Information We Collect

Information you provide to us. This includes your name, email address, phone number (including mobile number), billing and shipping address, order details, messages you send to our support team, reviews, survey responses, and, for bulk or corporate orders, your company name and job title.

Payment information. Payments are processed by our payment processors (such as Shopify Payments and PayPal). We do not store full payment card numbers on our systems.

Text message information. If you opt in to text messages, we collect your mobile number, the date, time, and method of your opt-in, a record of your consent, your interactions with our messages, and your opt-out status.

Information collected automatically. When you use the Site or open our emails and texts, we and our partners automatically collect information such as your IP address, approximate location derived from your IP address, browser and device type, time zone, pages and products viewed, referring websites or search terms, links clicked, and how you interact with the Site and our messages. We collect this using cookies, pixels, tags, log files, and similar technologies (see Section 5).

Information from third parties. We may receive information about you from service providers, advertising and analytics partners, shipping partners, and marketplaces we sell through.

2. How We Use Your Information

We use personal information to:
- Process and fulfill orders, including payment, shipping, returns, and order and delivery updates;
- Provide customer support and respond to your questions;
- Send marketing emails and text messages when you have given the required consent;
- Personalize your experience and show you relevant products and offers;
- Measure and improve the Site, our products, and our advertising;
- Detect, prevent, and investigate fraud, security issues, and misuse;
- Comply with legal, tax, and accounting obligations and enforce our Terms & Conditions.

3. Text Message (SMS) Program

If you opt in to receive text messages from STXND, we will use your mobile number to send recurring automated marketing messages (such as promotions, product launches, and cart reminders) and, where applicable, order and shipping updates. Consent to receive marketing texts is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to unsubscribe, or HELP for help. You can also contact us at support@stxnd.com. Carriers are not liable for delayed or undelivered messages.

We will not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes. All other categories, such as text messaging originator opt-in data and consent, will not be shared with third parties.

We share mobile information only with service providers that help us operate our text message program (for example, our messaging platform Klaviyo and wireless carriers), and only so they can deliver messages and support the program on our behalf. These providers are not permitted to use your mobile information for their own marketing.

4. How We Share Your Information

We share personal information only as described below:
- Service providers that perform services for us, such as Shopify (store platform), Klaviyo (email and SMS), payment processors, fulfillment and shipping partners, customer support tools, and analytics and hosting providers. They may use your information only to provide services to us.
- Advertising and analytics partners, such as Meta and Google, which may collect information through cookies and pixels on the Site to help us measure and deliver advertising. This does not include your mobile number or SMS opt-in data.
- Legal and safety purposes, to comply with law, respond to lawful requests such as subpoenas or court orders, or protect the rights, property, and safety of STXND, our customers, or others.
- Business transfers, in connection with a merger, acquisition, financing, or sale of all or part of our business.
- With your consent or at your direction.

We do not sell personal information for money. Under some U.S. state laws, allowing advertising partners to collect information through cookies and pixels for targeted advertising may be considered a "sale" or "sharing" of personal information. You can opt out of this as described in Section 6.

5. Cookies, Pixels, and Advertising

We and our partners use cookies, pixels, tags, and similar technologies on the Site and in our emails to keep the Site working, remember your cart and preferences, understand how visitors use the Site, and measure and personalize advertising. Some of these technologies are operated by third parties, who may collect information about your activity on the Site, such as pages you view and actions you take, and combine it with information from other sites.

You can manage cookies through our cookie banner, where available, and through your browser settings. You can also opt out of interest-based advertising at:
- Network Advertising Initiative: optout.networkadvertising.org
- Digital Advertising Alliance: optout.aboutads.info
- Meta: facebook.com/settings/?tab=ads
- Google: adssettings.google.com

Global Privacy Control. Where required by law, we treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your personal information for that browser. Because there is no common industry standard for "Do Not Track" signals, we do not respond to them.

6. Your Choices and Rights

Marketing choices. You can unsubscribe from marketing emails using the link in any email, and from text messages by replying STOP. We may still send you transactional messages about your orders.

United States. Depending on the state you live in (including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and other states with privacy laws), you may have the right to: know what personal information we collect, use, and disclose; access and receive a copy of it; correct it; delete it; and opt out of the sale or sharing of personal information and of targeted advertising. You may also appeal a decision we make about your request. We will not discriminate against you for exercising these rights. You may use an authorized agent to submit a request on your behalf.

European Economic Area, United Kingdom, and Switzerland. You may have the right to access, correct, delete, restrict, or object to the processing of your personal information, to data portability, and to withdraw consent at any time. We process your information to perform our contract with you (such as fulfilling orders), based on your consent (such as marketing messages), for our legitimate interests (such as improving the Site and preventing fraud), and to comply with legal obligations. You may also lodge a complaint with your local data protection authority.

How to make a request. Email support@stxnd.com with the subject line "Privacy Request." We will verify your identity before responding and will respond within the time required by applicable law.

7. Data Retention

We keep personal information for as long as needed to provide the Services and for the purposes described in this Policy, including to meet legal, tax, accounting, and dispute-resolution requirements. We keep records of text message and email consent and opt-outs for as long as needed to demonstrate compliance with applicable law.

8. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. International Transfers

We operate from Canada and the United States, and we and our service providers process information in Canada, the United States, and other countries. Those countries may have different data protection laws than where you live. When we transfer personal information, we take steps to protect it as required by applicable law.

10. Children

The Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us and we will delete it.

11. Third-Party Links

The Site may link to websites and services we do not control. Their privacy practices are governed by their own policies.

12. Changes to This Policy

We may update this Policy from time to time. When we do, we will post the updated version on this page and change the "Last updated" date. If we make material changes, we will provide additional notice as required by law.
